1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the WIGSA online store, located at [insert store URL] ("the Website", "we", "us" or "our"), and any purchase you make through it. WIGSA is an online retailer of women's wigs and hairpieces based in South Africa.

By accessing, browsing, registering an account, or placing an order on the Website, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, which are incorporated by reference. If you do not agree to these Terms, you should not use the Website.

These Terms are made available electronically in a manner that allows you to access, read, store and reproduce them, in accordance with the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). We recommend that you save or print a copy for your records.

2. Eligibility

To place an order you must be at least 18 years of age, or be assisted by a parent or legal guardian, and have the legal capacity to enter into a binding agreement. By placing an order you warrant that you meet these requirements and that the information you provide is accurate and complete.

4. Products and Product Descriptions

Our catalogue includes synthetic wigs and hairpieces such as bob wigs, long wavy wigs with bangs, afro kinky curly drawstring ponytails and headband wigs with highlights.

We take reasonable care to describe and display our products accurately. However, product images, colours and styling are provided for illustrative purposes only. The actual appearance of an item may vary due to factors such as your screen settings, lighting, photography, styling and the nature of synthetic hair fibre. Minor variations in colour, texture, length, density or cap size do not constitute a defect.

All products are subject to availability. We reserve the right to modify, discontinue or limit the availability of any product at any time without notice.

5. Pricing and Currency

All prices displayed on the Website are quoted in South African Rand (ZAR / R) and, where required by law, are inclusive of Value-Added Tax (VAT) unless otherwise stated. Prices exclude delivery charges, which are calculated and displayed separately at checkout.

We make every effort to ensure that pricing is accurate. Prices and promotional discounts (including any items shown on markdown or sale) may change at any time and without prior notice, and any such change will not affect orders that we have already accepted. From time to time a product may, despite our reasonable efforts, be incorrectly priced due to a technical, typographical or human error. Where an obvious pricing error occurs, we are not obliged to supply the product at the incorrect price and we reserve the right to cancel the affected order and refund any amount already paid, as set out in clause 6.

6. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the selected product(s) subject to these Terms. An automated order confirmation acknowledging receipt of your order does not constitute acceptance of your offer.

A binding contract of sale comes into effect only once we have confirmed acceptance of your order, for example by dispatching the product(s) or by sending a separate confirmation of acceptance. We reserve the right, in our sole discretion, to decline or cancel any order (whether in whole or in part) before or after acknowledgement, including but not limited to circumstances where:

  • the product is out of stock or no longer available;
  • there has been an error in the product description, image or price;
  • we are unable to verify your payment or delivery details;
  • we suspect fraudulent, unlawful or unauthorised activity; or
  • delivery to your location is not reasonably possible.

If we cancel an order for which you have already paid, we will refund the amount you paid for the cancelled item(s) using the original payment method, without undue delay.

7. Payment

Payment must be made in full at the time of checkout through the payment methods made available on the Website. All payments are processed by third-party payment providers, and your use of those services may be subject to their own terms and conditions. We do not store your full card details. You warrant that you are authorised to use the payment method you provide.

8. Delivery, Returns and Cooling-Off

Delivery arrangements, timeframes and costs are set out in our Shipping Policy.

Your rights to return goods and to receive a refund or exchange are set out in our Returns & Refunds Policy, which forms part of these Terms. Those rights include, where applicable, the statutory cooling-off right under section 44 of ECTA, which generally entitles you to cancel an electronic transaction for goods within seven (7) days after the date you receive the goods, without reason and without penalty (other than the direct cost of returning the goods). This cooling-off right applies in addition to, and does not limit, any rights you may have under the Consumer Protection Act 68 of 2008 ("CPA").

Please note that, for hygiene and health reasons, wigs and hairpieces are personal-care items worn directly on the head. Where a wig or hairpiece has been removed from its sealed or original packaging, worn, used, washed, cut, coloured or otherwise altered, it may not be eligible for a cooling-off return or refund, except where the product is defective, not as described, or where a non-excludable right under the CPA or other applicable law entitles you to a remedy. Please review that policy before placing an order.

9. Consumer Rights

Nothing in these Terms is intended to limit, exclude or waive any right you may have under the CPA, ECTA or any other applicable South African law that cannot lawfully be limited, excluded or waived. Where any provision of these Terms conflicts with a right you have under such law that cannot be excluded, that law prevails to the extent of the conflict.

10. Intellectual Property

All content on the Website — including the WIGSA name, logo, trademarks, text, graphics, product photographs, page layout, design and software — is owned by or licensed to us and is protected by South African and international intellectual property laws. You may view and use the Website for your own personal, non-commercial purposes only.

You may not copy, reproduce, republish, distribute, modify, sell or otherwise exploit any content from the Website without our prior written consent, except as expressly permitted by law. Any unauthorised use may result in the termination of your access and may give rise to civil and/or criminal liability.

11. Acceptable Use

You agree not to use the Website in any way that is unlawful, fraudulent or harmful, and in particular you agree not to:

  • interfere with, disrupt or attempt to gain unauthorised access to the Website or its systems;
  • introduce viruses, malware or other harmful code;
  • use the Website to transmit unsolicited communications; or
  • infringe the intellectual property or other rights of WIGSA or any third party.

12. Third-Party Links

The Website may contain links to third-party websites or resources that are not operated by us. We provide these links for convenience only and are not responsible for the content, products, services or privacy practices of any third-party site. Accessing such sites is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by applicable South African law, and subject to clause 9:

  • the Website and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, other than those that cannot lawfully be excluded;
  • we do not warrant that the Website will be uninterrupted, error-free or free of viruses or other harmful components;
  • we shall not be liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Website or any product purchased through it; and
  • our total liability arising out of or in connection with any order shall not exceed the amount actually paid by you for the relevant product(s).

Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law, including any non-excludable liability under the CPA.

14. Indemnity

You agree to indemnify and hold WIGSA, its owners, employees and agents harmless from any claim, loss, liability or expense (including reasonable legal costs) arising out of your breach of these Terms or your unlawful or improper use of the Website, to the extent permitted by applicable South African law.

15. Privacy and Personal Information

Your personal information is collected, used and protected in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 ("POPIA"). Please refer to our Privacy Policy for details of how we process your personal information and of the lawful basis on which we do so.

16. Changes to These Terms

We may amend these Terms from time to time to reflect changes in our business, the law or our practices. The version published on the Website at the time you place an order is the version that applies to that order. Your continued use of the Website after any change constitutes acceptance of the amended Terms. We encourage you to review this page periodically.

17. Severability and Waiver

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

18. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, the Website or any product purchased through it, are governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the jurisdiction of the South African courts.
